Douglas D. Moseley

Douglas D. Moseley is an experienced litigator with a long history of insurance defense work.  He has tried numerous cases in circuit courts throughout the State of Michigan as well as in federal district court. Doug has focused his career on defending businesses and individuals in cases involving first and third party automobile claims, premises liability matters, construction cases and in dram shop litigation.

Dram Shop/Business Litigation:

Doug gained a great deal of his experience representing businesses providing entertainment services such as bars, restaurants, bowling centers and other related businesses. These types of clients enabled him to try cases involving the Michigan Dram Shop Act, premises liability claims of all types and claims arising out of the criminal actions of third parties. He worked closely with the claim professionals assigned to these claims not only as counsel, but as one who could educate them regarding the unique aspects of this type of litigation. He was a frequent contributor at seminars for the dram shop industry and worked with local and state organizations to address the state of the law and evaluate risk management measures. Doug also published a series of articles in the Beverage Journal, the official publication of MLBA (Michigan Licensed Beverage Association).

Motor Vehicle Litigation:

As most attorneys involved in insurance defense work, Doug Moseley has always been involved in automobile litigation. He has been involved with this type of work through all the major changes, both legislative and judicial, involving the third party recovery threshold. He has handled first party personal injury protection (PIP) cases at all levels, assisting carriers in determining whether or not to continue benefits.

Construction Litigation:

Doug has always enjoyed representing building contractors. Many of his family members work in the industry and Doug learned, first hand, the reality of such work during his college years. He spent his summers working as a laborer on a construction crew installing drain and sewer pipe. This experience enabled him to understand the nature of job site problems and how to readily explain these situations to lay jurors and arbitrators. He has handled both injury and property damage cases arising out of construction site accidents.

General Liability Litigation:

While Doug has always been involved with insurance defense work, he has also handled other types of litigation at various times in his career. For example, he has represented:

Clients as counsel in §1983 actions and local ordinance litigation;

Defended employers in various employment cases; and

Assisted a local country rock band by serving as the band’s general counsel, manager and publicist in its efforts to obtain a recording contract.

Education and Honors:

Doug graduated in 1973 from Michigan State University with high honors. He attended Wayne State University Law School receiving his Juris Doctor degree in 1979. He was admitted to practice in Michigan in 1979. He has appeared in many different state circuit courts and is admitted to the federal district courts and the 6th Circuit Court of Appeals.

In the area of Alternative Dispute Resolution, he has served as both an arbitrator and case evaluator in many different kinds of litigation. Throughout his career, he has always enjoyed the camaraderie and challenge that comes with being a litigator and is committed to the firm’s goal of excellence at all times in protecting the rights of the firm’s clients and their insurers.
